Regulations on Fees for Organizations

The administrative procedure for notifying personal data processing is subject to the payment of a fee, as established by the National Data Protection Commission (CNPD) in Deliberation no. 1/2015, published in Official Bulletin no. 44, Series II, of September 18, 2015.

Amount of fees

  • Notifications of data processing that do not require prior authorization
    • Fixed fee: 3,000$00 (three thousand escudos).

  • Processing that requires prior authorization, under Law no. 41/VIII/2013, of September 17, amended by Law no. 121/IX/2021, of March 17, or other applicable legal provisions
    • Fixed fee: 5,000$00 (five thousand escudos)
    • In case of special complexity, duly justified by the CNPD, a fee up to 7,000$00 (seven thousand escudos) may be applied.

Economic-financial justification

The definition of the fee amounts is based on the estimation of the following costs:

  • Costs with administrative processing and handling of notification forms;
  • Technical costs associated with analysis and issuance of opinions.

Method of settlement and payment

Payment deadline

  • Electronic means: payment must be made within a maximum of 5 working days after submitting the form on the CNPD portal.
  • In person or by mail (paper): payment must be made at the time of delivery or, if anticipated, must include proof.
  • In case of fee update due to special complexity, the payment of the difference must be made within 5 working days after notification.

Payment methods

  • Bank transfer (via online banking or in person);
  • Check issued to the order of the CNPD, delivered in person.

It is mandatory to indicate the payment reference code provided by the CNPD at the time of form submission.

Payment in installments

The CNPD may authorize the payment of fees in installments, by deliberation and provided that the applicant's economic situation justifies it. In these cases:

  • Half of the fee is paid as mentioned above;
  • The other half must be paid 30 days later.

Non-payment

Failure to pay the fee within the foreseen deadlines implies that the notification will not be considered valid.

Errors in the settlement of the fee

  • If the applicant entity pays the fee for the granting of prior authorization and the CNPD considers that the processing is not subject to such authorization, the difference between the respective fee amounts is refunded.
  • If the applicant entity pays the fee for a mere registration and the CNPD verifies that the processing requires prior authorization, the entity is notified to pay the difference within 5 days of receiving the respective guides.

Refund

  • Payments made without the reference code may be refunded upon request within 30 days, with proof of payment.
  • In these cases, the CNPD will return 90% of the amount paid to the applicant, with 10% retained for administrative expenses.
