In an era where "modern information technologies have so profoundly infiltrated our living spaces and intensely shape human experience across all sectors," the risks of privacy intrusions through personal data processing have escalated. This makes robust data protection systems indispensable—ensuring the effective exercise of the right to "informational self-determination."

In Cabo Verde, many citizens remain unaware that they are entitled to this right. As an independent administrative body, the National Data Protection Commission (CNPD) is tasked with overseeing and enforcing compliance with legal and regulatory provisions on personal data protection. Our mission is to uphold the human rights, freedoms, and safeguards enshrined in the Constitution and national law.

This National Data Protection Commission website was designed as:

  • A direct, accessible, and comprehensive communication channel on the CNPD’s functions and activities
  • A platform to raise awareness about citizens’ data protection rights and provide practical tools for legal compliance.

Recognizing the challenges ahead, this space is also an open invitation for suggestions and contributions from citizens.

What are we?

The Comissão Nacional de Proteção de Dados (CNPD) is an independent administrative entity, created under Law No. 42/VIII/2013, of September 17, with the aim of ensuring the protection of personal data and respect for the fundamental rights and freedoms of citizens, in accordance with the Constitution and Cape Verdean legislation.

Legal Framework

The CNPD is governed by the aforementioned Law and applicable legal provisions, taking an independent position within the National Assembly. This autonomy is reflected in its ability to supervise, monitor, and ensure compliance with regulations regarding personal data protection, both in Cape Verde and within the framework of international agreements.

Mission

To promote and ensure the protection of personal data, ensuring transparency and compliance with legal obligations by public and private entities, as well as defending the rights and freedoms of data subjects.

Functions

Among the main functions of the CNPD, the following stand out:

  • Supervision and oversight: Monitor the compliance with data protection regulations throughout the national territory.
  • Regulation: Authorize and regulate the processing of personal data, including international transfers and database combinations.
  • Consulting: Issuing opinions on legislative initiatives related to data protection.
  • Education and awareness: Promote digital literacy and raise awareness about the importance of privacy and information security.
  • International cooperation: Collaborate with data protection authorities from other countries and defend the rights of Cape Verdean citizens abroad.


Headquartered in Praia, the CNPD is committed to transparency, trust, and security in the processing of personal data, contributing to a more inclusive and responsible digital society.

Competencies 

According to paragraph 1 of article 10 of Law no. 42/VIII/2013, of September 17, it is the responsibility of the CNPD:

  • Authorize or register, as the case may be, the processing of personal data;
  • Exceptionally authorize the use of personal data for purposes not determined at the time of collection, in compliance with the principles defined by law;
  • Authorize, in cases provided for by law, the interconnection of automated personal data processing;
  • Autorizar a transferência de dados pessoais nos casos previstos na lei;
  • Determine the retention period for personal data based on its purpose, and may issue directives for specific sectors of activity;
  • Ensure the right of access to information, as well as the exercise of the right to rectification and updating;
  • Authorize the setting of costs or frequency for the exercise of the right of access, as well as establish maximum deadlines for compliance, in each sector of activity, with the obligations that, under the law, fall upon the data controllers.
  • Follow up on requests made by any individual, or by an association representing them, for the protection of their rights and freedoms regarding the processing of personal data and inform them of the outcome;
  • Carry out, at the request of any individual, a verification of the lawfulness of data processing, whenever such processing is subject to access or information restrictions, and inform the individual about the verification carried out;
  • Examine complaints, grievances, or petitions from individuals;
  • Waive the implementation of security measures, as provided by law, and may issue directives for specific sectors of activity;
  • Ensure the representation of Cape Verde in international bodies within the scope of its competencies;
  • Impose fines;
  • Promote and evaluate codes of conduct;
  • Promote the dissemination and clarification of rights related to data protection and regularly publicize its activities, particularly through the publication of an annual report;

Who Are We?

Structure of the National Data Protection Commission

Composition

The Comissão Nacional de Proteção de Dados (CNPD) is composed of three individuals of recognized competence and moral integrity, elected by the National Assembly by a two-thirds majority of the deputies present, provided it is greater than the absolute majority of deputies in office. The CNPD also includes a secretary with a degree and recognized competence for the performance of the position, as well as administrative and technical support staff.

Faustino Varela Monteiro (President)

Leads the CNPD with commitment and rigor, ensuring the fulfillment of its legal duties and the protection of citizens' fundamental rights.

Djamilson Pinto

As a member of the CNPD, he/she contributes with his/her experience and knowledge to ensure compliance with legal provisions regarding data protection.

José Maria de Pina

As a member of the CNPD, he/she plays a key role in overseeing and monitoring activities related to data protection in Cape Verde.

Gregório Varela 
The position of Secretary of the CNPD is held by a professional with a degree, who ensures the coordination of the administrative and technical services necessary for the smooth functioning of the entity.
